The Constitutional court declared unconstitutional the requirement of 1,300 weeks of contributions for women to obtain their pensionwhich was established in Article 9 of Law 797 of 2003.

The reason said by the Court has been «the difference in pension age, which has been the scheme traditionally used by the legal regime in the country«referring to this area»today it is insufficient in order to deepen the application of the constitutional mandate to overcome discrimination based on gender and, even, it is deactivated by demanding the same contribution density from women as from men, in less time«.

This means, in simple words, that the female population in Colombia will not have to contribute 1,300 weeks to retire as men have to, taking into account that the pension age is 57 years for women.

In addition to this, as established by the Court, a mechanism was structured by which the contribution figure has a gradual reduction up to 1,000 mandatory weeks.

This staggered subtraction will start from the January 1, 2026year in which the figure will have a reduction of 50 weeksthat is, it will remain at 1,250 at the end of the year.

From January 1, 2027the annual reduction would be 25 weeksup to 1,000. This means that women will be able to retire with 1,000 weeks of contributions from January 1, 2037.

It is worth clarifying that, according to figures from the National Administrative Department of Statistics (Dane)As of April 2023, out of a total of 20.5 million women of working ageonly 9.3 million are employedTherefore, this regulation currently affects women who are working, but who have not yet managed to complete the 1,300 weeks required for their retirement.
