A New York appeals court will rehearse a previously dismissed case involving transgender high school athletes in Connecticut, according to News 8 WTNH.

The lawsuit was filed three years ago by four cisgender track and field athletes, who claimed it was unfair to have to compete against transgender athletes.

After a year of consideration, the case was dismissed after the girls’ claims were deemed «speculative».

“I hope that the court realizes the importance of this issue and that they restore fairness to women’s sports,” said Alanna Smith, one of the plaintiffs.

Smith is one of many athletes who have spoken out about the unfairness of competing against transgender athletes.

She lost to transgender athletes while participating in track events in Danbury, Connecticut.

«I’m also very optimistic that equity will be restored to women’s sports, and I hope we can keep women’s sports women’s sports,» Smith said.

The American Civil Liberties Union said it will defend Connecticut’s current policy that allows transgender athletes to compete as the gender they identify with.

His defense refers to Title IX, on which the court previously based its decision. The Connecticut Intercollegiate Athletic Commission also stands behind the earlier decision on the lawsuit.

«CIAC has been confident in its inclusion policies since the beginning of this case,» he told News 8 WTNH. «CIAC was satisfied with the above decision… and looks forward to presenting its position before the full Circuit Court.»

This debate has seen numerous lawsuits and arguments across the country, with prominent advocates for women’s sports like former NCAA swimmer Riley Gaines and broadcasters Sage Steele and Sam Ponder speaking out.
